刚拿回护照，三天前面签通过的L1A。

L1签证适用于公司内部转移，可以有公司集中申请(blanket petition)，基本要求：

1. 过去三年中在公司工作了一年以上；2. 公司在美国有运营实体。具体对公司有一些要求，就不细说了。具体而言，L1签证又分L1A和L1B：L1A适用于管理人员，L1B适用于专业技术人员。申请时都要阐明工作职责和能力对公司而言是不可或缺，不能在美国招聘到替代人员，且工资高于平均水平。L1签证申请人可以有移民倾向，家属以L2签证赴美可以工作。这两种签证的区别主要在于L1A申请绿卡时通过EB1C流程，不用再经劳工部审查就不用受配额限制去等几年的排期，且签证最长可以有七年；L1B申请绿卡则要走普通通道，签证最长可达五年。根据自己的经验，具体说一下L1A。一般介绍都说L1A适用于“高管”，其实要求没那么高。按USCIS说明，L1A适用于Executive or Manager，而一般的问题都在于Manager的定义，毕竟Executive在公司里还是蛮明确的。根据法案8 CFR 214.2(l)(1)(ii)要求，Manager的职能要求有四点：(1) Manages the organization, or a department, subdivision, function, or component of the organization;(2) Supervises and controls the work of other supervisory, professional, or managerial employees, or manages an essential function within the organization, or a department or subdivision of the organization;(3) Has the authority to hire and fire or recommend those as well as other personnel actions (such as promotion and leave authorization) if another employee or other employees are directly supervised; if no other employee is directly supervised, functions at a senior level within the organizational hierarchy or with respect to the function managed; and(4) Exercises discretion over the day-to-day operations of the activity or function for which the employee has authority. A first-line supervisor is not considered to be acting in a managerial capacity merely by virtue of the supervisor's supervisory duties unless the employees supervised are professional.需要特别说明的是，没有直接下属是可能满足L1A要求的。我在准备申请材料时咨询过一些人，他们都把有下属(direct report)作为L1A的要件，甚至要求有几个以上。我自己查了资料，再与美国专做移民的律所联系，并最终和公司处理我的申请的律师确认，可以按functional manager申请。不过也需要注意，在公司官方出具的职位描述上需要明确满足上面的四点要求。
